Terms of Service of Salus - HRM sp. z o.o., hereinafter referred to as Sun Seasons 24
I. GENERAL PROVISIONS
- Salus Human Resources Management sp. z o.o., with its registered office in Wrocław, Pl. Powstańców Śląskich 17a, unit 222, entered into the National Court Register maintained by the District Court Wrocław Fabryczna, XI Economic Division of the National Court Register in Wrocław under the number 0000270266, NIP 894-288-73-55, with a share capital of PLN 5,000.00, hereinafter referred to as Sun Seasons 24, provides Services commissioned by legal and natural persons consisting of renting apartments for leisure and training purposes.
- These Terms and Conditions constitute an integral part of the apartment rental contract. The other parts of the contract are the Rental Agreement based on the reservation, the House Rules, and the Price List of services provided by Sun Seasons 24.
II. DEFINITIONS OF TERMS USED IN THE TERMS AND CONDITIONS:
- SUN SEASONS 24 - a company providing apartment rental services.
- OBJECT - a building where the apartment rented by SUN SEASONS 24 is located.
- MANAGER - an authorized person representing SUN SEASONS 24 to manage the apartments.
- RESERVATION FORM - an electronic document that is the only form of reservation via the Internet.
- DEPOSIT - a fee of no less than 50% of the Service price, which secures the flat-rate costs associated with preparing the apartment.
- RESERVATION - preliminary entitlement to use the apartment under the conditions specified in these Terms and Conditions.
- RENTAL AGREEMENT - a document constituting the right to use the apartment under the conditions given in the reservation form and the terms contained in the agreement.
- CLIENT - a legal or natural person with legal capacity under the provisions of the Civil Code.
- COMPENSATION - compensation due to Sun Seasons 24 for the preparation and reservation of the apartment and lost benefits.
III. SCOPE OF THE TERMS AND CONDITIONS
- The Terms and Conditions define the rules for providing apartment rental services by SUN SEASONS 24.
- SUN SEASONS 24 may introduce separate regulations for the Services it provides, particularly related to promotional campaigns.
IV. RESERVATION RULES
- The current offer of available apartments is available on the SUN SEASONS 24 website - www.sunseasons24.pl.
- Reservations of apartments are made on the website by completing and submitting the reservation form, which is an integral part of the service or directly with the manager of the property or a Customer Service Center employee.
- The Client is fully responsible for the consequences of providing incorrect data in the form.
- After agreeing on the date and rental conditions of the apartment, the Client is obliged to pay the deposit.
- The reservation is effective upon payment of the deposit of no less than 50% of the total amount due for the entire stay. The receipt of this amount in the bank account is the confirmation of the apartment reservation.
- The payment for the stay is to be made no later than on the day of arrival by bank transfer, payment card, or cash to the property manager, at which time the Client receives the deposit refund.
- Free cancellation, change of reservation date, or change of the apartment to another is possible up to 14 days before the planned arrival date.
- The free cancellation period may be different (longer or shorter), but it must be in accordance with the information provided in the sales service of the accommodation service.
V. COMPENSATION
- If the Client cancels the reserved apartment after paying the deposit within a period shorter than the free cancellation period (section IV;g,h), SUN SEASONS 24 is entitled to compensation for lost benefits amounting to 50% of the service value.
- In the event of the circumstances described in section V; a, the Client agrees to mutual compensation of the amount due to the Client for the deposit refund with the amount due to Sun Seasons 24 as compensation for not renting the apartment.
- In the event of the circumstances described in section V; a, when the deposit has been collected (section IV g), SUN SEASONS 24 will retain 50% of the service value as compensation, and the remaining amount will be refunded to the account indicated by the Client.
- If the Client cancels the reserved apartment during the stay, SUN SEASONS 24 is entitled to compensation for lost benefits equal to the fee for the unused part of the service.
- The parties declare that the specified compensation for Sun Seasons 24 exhausts the claims of the parties arising from the concluded agreement in terms of reservation or early termination of the stay.
VI. RULES FOR HANDING OVER AND RECEIVING THE APARTMENT BY THE CLIENT
- Check-in takes place on the day of arrival at the regional office or at the apartment address (detailed information on the check-in procedure is provided in the offer of each apartment).
- Guests must vacate the apartment and return the keys by 10:00 AM on the last day of stay unless otherwise agreed.
- The Client is obliged to immediately notify the Manager or the person responsible on behalf of SUN SEASONS 24 of any events that may expose SUN SEASONS 24 to damage.
- Guests bear financial responsibility for damages caused during their stay in the apartment.
- The detailed housekeeping rules for using the apartment are described in the House Rules applicable in the given premises.
VII. PRICE AND PAYMENT TERMS
- The rental prices for individual apartments throughout the calendar year are determined by the Price List of Services Provided by SUN SEASONS 24.
- The currency unit is the Polish zloty (PLN).
- The payment for the provided services can be made:
- by bank transfer to the Sun Seasons 24 bank account,
- online via Tpay,
- in cash to the Manager before renting the apartment (if checking in with key collection from a locker - this option is not available).
- In any case, the full payment for the stay and the recognition of the Client's account must be made before the rented apartment is handed over to the Client.
VIII. LIABILITY
- In the event of force majeure, i.e., extraordinary circumstances beyond either party's control, natural disasters, pandemics, strikes, acts of war, or other exceptional situations preventing the service from being carried out in accordance with the agreement, Sun Seasons 24 is released from the obligation to fulfill the order.
- In the event of temporary difficulties in the supply of electricity, water, gas, Internet, TV signal on the part of external suppliers, Sun Seasons 24 is not responsible for their absence.
- In the event of random situations on the part of Sun Seasons 24 that prevent the use of the apartment (e.g., defects, breakdowns), Sun Seasons 24 may offer guests an apartment of a similar standard or reserves the right to cancel the reservation with a full refund.
- In the event of the circumstances described in section VIII; b, Sun Seasons 24 will take all measures and actions to restore access to these media as soon as possible or offer (if possible) a replacement apartment.
- Sun Seasons 24 is not responsible for difficulties in accessing the reservation system for reasons beyond its control. Therefore, access to the www.sunseasons24.pl service may be suspended for the period necessary to remove technical and organizational obstacles.
IX. COMPLAINTS
- The Client has the right to use the right to complain about the service and pursue claims in this regard, in accordance with the applicable provisions of law.
- A condition for considering the complaint is its submission in writing to the headquarters of Sun Seasons 24 or by email to the Customer Service Center at [email protected]. The headquarters address is available on the website under the "Contact" tab.
- Complaints will be considered within 30 days of their receipt. Information on the outcome of the complaint will be sent to the Client to the email address, postal address, or by phone.
X. PERSONAL DATA
- By making a reservation on the www.sunseasons24.pl website, the Client agrees to have their personal data entered into the database of the www.sunseasons24.pl service and SUN SEASONS 24.
- The data controller is SALUS - HUMAN RESOURCES MANAGEMENT sp. z o.o (Salus - HRM) with its registered office in Wrocław, Pl. Powstańców 17A/222, registered in the District Court for Wrocław Fabryczna in Wrocław, VI Economic Division of the National Court Register, No. KRS 0000270266, NIP 8942887355, REGON 020419404.
- Personal data is processed based on the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, including based on Article 6(1) points "b", "c", "f".
- Processing personal data by the data controller is necessary for the performance of the contract with the data controller, for making reservations, facilitating future reservations, for marketing purposes, and to fulfill the legal obligations of the data controller or to pursue claims.
- Personal data will be stored until the expiry of the limitation period for claims and until the expiry of the period for storing documentation related to the contract, resulting from generally applicable laws.
- The data will be disclosed only to persons authorized by the data controller to process personal data and to entities processing personal data on behalf of the data controller based on agreements concluded with the data controller.
- The Client has the right to access their personal data, request its rectification, supplementation, deletion, or restriction of processing, the right to object to the processing, the right to data portability, and the right to lodge a complaint with the supervisory authority overseeing data processing in accordance with data protection regulations.
- Personal data will not be transferred to a third country within the meaning of the Regulation (EU) 2016/679.
- No automated decision-making, including profiling, will be applied.
XI. OTHER
In matters not regulated by the Terms and Conditions, the relevant provisions of the Civil Code and the Act will apply.
The Terms and Conditions are effective from: July 1, 2020.
